These Terms and Conditions of Sale apply to all orders placed on the website https://www.chambfrance.com/ (hereinafter referred to as “the site”).
These terms and conditions of sale (hereinafter the “T&Cs”) govern the sale of products offered between:
on the one hand:
the French company EARL Cham B, with its registered office at 152 rue du Pic Vert – 16130 JUILLAC-LE-COQ, registered with the Angoulême Trade and Companies Register under number 912 869 617, with intra-community VAT number FR06912869617, hereinafter referred to as “the Company.”
and on the other hand,
by any individual or legal entity wishing to make a purchase through the website https://www.chambfrance.com/. Hereinafter referred to as “the Buyer” or the “Customer.”
The parties agree that their relationship will be governed exclusively by this contract, to the exclusion of any terms previously available on the website. However, if a provision is found to be missing, it shall be considered governed by the customary practices in effect within the distance selling sector for companies based in France.
The Customer acknowledges that, prior to placing an order, they have read and understood all of the above information and the Terms and Conditions of Sale.
- Purpose
Scope of Application
These terms and conditions of sale (hereinafter the “T&Cs”) aim to define the contractual terms (Rights and Obligations) between the company EARL CHAM B and the Buyer, in the context of the sale of products by EARL CHAM B through its e-commerce website: https://www.chambfrance.com/.
This contract is composed of these Terms and Conditions of Sale and the order form. However, the photographs illustrating the products on the Site are not part of the contractual terms. If any errors or alterations occur due to the processing of these photographs or their display on the user’s screen, EARL CHAM B’s liability cannot, under any circumstances, be held responsible.
Duration of Application and Amendments to the Terms and Conditions of Sale
These Terms and Conditions of Sale are effective as of 07/20/2025. This edition supersedes and replaces all previous versions.
These T&Cs are agreed upon, upon their acceptance, for the entire duration of the execution of any Order placed under these T&Cs and any warranties associated with the EARL CHAM B Products concerned by the Order, except in cases of termination/resolution or force majeure.
EARL CHAM B reserves the right to adapt or modify these Terms and Conditions of Sale at any time and without notice. In the event of a modification, the Terms and Conditions of Sale in effect on the date of the order shall apply to each order.
- Product Availability
The products and services offered by EARL CHAM B are presented on its Site in French. Any citizen of the European Community or of countries complying with Directive 95/46/EC cannot invoke their lack of language proficiency as a reason to cancel the contract.
Product offers and prices are valid as long as they are displayed on the Site, subject to available stock.
In the event of product unavailability after an order has been placed, the Customer will be informed by email or phone as soon as possible.
EARL CHAM B will offer a similar product at the same price. If the Customer does not accept this alternative, and if payment has already been processed, a refund will be issued within a maximum of thirty (30) days.
On our website, all products are theoretically available. If we are unable to deliver a product for any reason, we will refund the total cost of the order within ten days of sending the email notifying you that the ordered product is unavailable. Refunds will be processed as a credit to your account using the same method as the original payment. We cannot be held responsible if products from our suppliers are out of stock, resulting in a delay in the delivery of your order.
Due to the nature of the Internet, EARL CHAM B does not guarantee real-time availability of all products and services on its Site.
- Geographical Area
The products sold online and presented on the Site are delivered to Metropolitan France (including Corsica), to countries within the European Community, and worldwide (with exceptions).
However, it is the responsibility of the Customer, as the importer of the products, to ensure compliance with the legal requirements of their country. Accordingly, the ordered products are imported into the destination country by and under the responsibility of the Customer. Furthermore, the Customer will carry out all necessary procedures regarding taxes, customs or import duties, and, more generally, any related fees.
The Customer acknowledges and agrees that they cannot validly invoke the right of withdrawal described in Article 13 if they do not comply with the obligations mentioned in the previous paragraph.
- Order
Any order form signed by the Customer via “double click” constitutes an irrevocable acceptance, which can only be challenged in the cases strictly provided for in this contract.
Indeed, the “double click,” combined with the authentication and non-repudiation procedure and the protection of message integrity, constitutes an electronic signature within the meaning of Article 1316-4 of the French Civil Code.
Any agreement to a quote sent by email to the Buyer, and returned to EARL CHAM B with explicit consent, also constitutes an irrevocable acceptance.
Order Process
Prior to placing any Order, the Buyer declares that the purchase of any Product is intended for private and personal use only, excluding any commercial, competitive, or other purpose that could harm EARL CHAM B.
Any Buyer wishing to purchase a product online must follow the procedure described below.
In order to place an Order, the Buyer must first have an Account and be logged into that Account using their credentials. If the Buyer does not already have an Account, the creation of an Account is offered to the User during the order process.
The Buyer must complete the online order form by providing all the references of the chosen products, as well as the desired quantities.
The information and details provided by the Buyer when placing the order are binding. In the event of any input errors, EARL CHAM B cannot be held responsible for the resulting consequences or for any inability to ensure delivery.
This clause applies in the event of a delay or delivery error: in such cases, all costs incurred by EARL CHAM B for reshipping the order will be entirely borne by the Buyer.
The Buyer must check the details of their order and the total price. They have the opportunity to correct any errors before confirming the order.
By validating the order, the Buyer accepts the Terms and Conditions of Sale, acknowledges having fully read and understood them, and, where applicable, waives the right to invoke their own purchasing terms or any other conditions.
Order Confirmation
Any order placed with EARL CHAM B must be confirmed by the company in order for the order to be definitively accepted.
All orders are subject to the Seller’s acceptance. Indeed, EARL CHAM B reserves the right to cancel any order from a Customer with whom there is a dispute regarding the payment of a previous order, or in other cases provided for in this contract.
The order confirmation will be sent by email to the Buyer as soon as possible, provided that the Buyer supplies a valid email address that is not subject to usage restrictions (for example, a professional email address). In this specific case, EARL CHAM B cannot be held responsible for the non-receipt of the order confirmation, which contains all contractual information and serves as proof of the transaction.
Each order confirmation includes a delivery date for the respective order. The delivery timeframe indicated at the time of order placement is provided for informational purposes only and without any guarantee.
Consequently, exceeding this timeframe cannot give rise to any compensation of any kind and cannot justify the cancellation of the order.
Furthermore, the indicated timeframe is automatically suspended in the event of any circumstance beyond the control of EARL CHAM B that results in a delay in making the products available.
The Customer assumes all costs and risks associated with the loading and transportation of the products sold, from the time they are made available until they arrive at their destination.
However, without contradicting the above, when the Customer pays for their order by check, the order confirmation will specify a delivery timeframe, which will only begin once EARL CHAM B has definitively cashed the check.
In any case, the availability of the products within the specified timeframe can only occur if the Customer has fulfilled all of their obligations toward Cham B.
- Price
Unless otherwise expressly stated, the prices of the products sold are those listed in the online store on the day the order form is submitted. The prices shown in the online catalog are expressed in euros, including all taxes (VAT included). They reflect the VAT rate applicable on the day of the order. They do not include shipping costs, which are charged separately and indicated in the order confirmation.
All orders must be paid in advance in euros.
Prices are valid as long as they are displayed on the Site, subject to available stock.
EARL CHAM B reserves the right to modify prices at any time and undertakes to apply the rate in effect on the date the order is confirmed, subject to the availability of the ordered product on that date.
- Product Characteristics
Each EARL CHAM B Product sold on the Site is accompanied by a descriptive sheet detailing its essential characteristics, which the User is invited to read carefully before placing any Order.
EARL CHAM B makes its best efforts to ensure that the visuals of the Products (including photographs, videos, drawings, and diagrams representing the Products) are as accurate as possible.
However, EARL CHAM B cannot guarantee a perfect match between the visuals shown on the Site and the Products actually offered for sale (particularly regarding color, materials, etc.). Consequently, Product visuals are not contractually binding. The Buyer is encouraged to refer to the descriptive sheet of each Product to know its precise characteristics.
- Payment and Invoicing Terms
EARL CHAM B provides the Buyer with a payment method that offers maximum security and guarantees:
– Bank or private card (Carte Bleue, Visa, Eurocard/Mastercard), by entering, directly in the designated field (secure entry via SSL encryption), the card number without spaces, its expiration date, and the security code.

The Customer guarantees to EARL CHAM B that they have any necessary authorizations to use the chosen payment method when confirming the order form.
EARL CHAM B reserves the right to refuse any order from a Buyer with whom a payment dispute is ongoing or from a Buyer who has not fully or partially paid for a previous order.
For credit card payments, certain verifications may be carried out by EARL CHAM B. When the information provided by the Customer is verified by EARL CHAM B, the data related to the Customer’s order is subject to automated data processing managed by EARL CHAM B. This automated data processing is intended to assess the transaction and prevent credit card fraud.
EARL CHAM B is the recipient of the data related to the Customer’s order. Failure to provide the data related to the order prevents its analysis and, consequently, the completion of the purchase.
The occurrence of a non-payment due to fraudulent use of a credit card will result in the details related to the associated order being recorded in a payment incident file maintained by EARL CHAM B. Any irregular declaration or anomaly may also be subject to specific processing.
In accordance with the French Data Protection Act of January 6, 1978, you have the right at any time to access, correct, and object to all of your personal data by writing and providing proof of identity to: EARL CHAM B, 152 rue du Pic Vert – 16130 JUILLAC-LE-COQ.
- Retention of Title Clause
CHAM B retains ownership of the goods sold until full payment of the price, including principal and ancillary amounts (including, but not limited to, taxes, fees, and shipping costs). For the purposes of this clause, payment is understood as the actual receipt of the price by EARL CHAM B.
If the Customer undergoes judicial reorganization or liquidation, CHAM B reserves the right to claim, within the framework of the collective proceedings, the goods sold that remain unpaid.
The documents provided to the Customer are governed by the Intellectual Property Code. They remain the property of EARL CHAM B. Therefore, it is prohibited to reproduce, transfer, or exploit the provided documents without the consent of EARL CHAM B.
Le Client s’engage, jusqu’à complet paiement du prix, à peine de revendication immédiate des produits par EARL CHAM B, à ne pas transformer lesdits produits ni à les revendre ou les mettre en gage.
The transfer of risk takes effect upon the actual delivery of the products ordered from the online store.
- Order Fulfillment
EARL CHAM B reserves the right to refuse an order for a “legitimate reason” (as defined by case law), including (but not limited to) product unavailability, abusive requests from the Customer, a presumption that the Customer is unable to contract, or a clear intention by the Customer to harm EARL CHAM B.
EARL CHAM B also reserves the right not to fulfill an order in the case of a clear typographical error resulting in an obvious “incorrect price,” even after the order has been confirmed to the Customer. The Customer understands and agrees that they cannot claim any compensation of any kind as a result. EARL CHAM B will contact the Customer to determine whether they wish to proceed with or cancel their order at the corrected price.
Finally, the company reserves the right to refuse an order in the event of a dispute with the Customer, non-payment (in full or in part) of a previous order, or refusal of bank authorization during the online payment process.
In any case, EARL CHAM B undertakes to process the order as promptly as possible in order to deliver the ordered products on the date specified in the order form.
- Invoicing
An invoice will be automatically sent to the Customer upon placing their order. It will be sent to the email address provided by the Customer during the order, unless otherwise specified by them.
- Delivery
As a reminder, products purchased on the site https://www.chambfrance.com/ can be delivered to Metropolitan France (including Corsica), countries within the European Community, and worldwide (with exceptions).
However, the following delivery addresses are not accepted: P.O. boxes, CEDEX addresses, and military bases.
Products are shipped to the delivery address(es) provided during the order process. The Customer can track the order to monitor the progress of the delivery.

We insure the goods up to the delivery location. It is the recipient’s responsibility to check the package in the presence of the delivery person and to make any claims immediately in case of an issue.
Shipping costs are calculated based on the type of service chosen, the type of products purchased, and the total weight, if applicable.
The delivery times announced in the Delivery section of the Site are calculated in business days. The indicated times are average estimates, corresponding to the processing, preparation, and shipping of the order.
With every order, a document (containing the information required by Article L 121-19 of the French Consumer Code) will be provided, summarizing:
– the identification and contact details of the company
– the shipping costs
– the payment and delivery terms
– the essential characteristics of the product
– the price
– the address to which complaints should be sent
– information regarding after-sales service
Any defect or delivery delay exceeding seven (7) business days must be reported to our Customer Service as soon as possible.
If you receive the product after your order has been canceled, you must return it to us complete and in its original condition so that we can process a refund upon receipt.
In the event of a missing or damaged product during transport, the Customer must make all necessary reservations upon receipt of the products. These reservations must be handwritten and signed, noting any delivery anomalies (opened package, damaged product, “the delivery person refused to wait for unpacking,” etc.). This verification is considered complete once the Buyer, or an authorized person, has signed the delivery slip.
- Right of Withdrawal
In accordance with Article L121-20 of the French Consumer Code, the Customer has a period of seven (7) full days to exercise their right of withdrawal without having to provide any reason or pay penalties, except, where applicable, for return shipping costs. The seven (7) day period begins from the date of receipt of the ordered products (noting that if the period expires on a Saturday, Sunday, public holiday, or non-working day, it is extended to the next business day).
However, the Customer may not invoke this right in the following cases:
– provision of a service whose performance has begun or been completed before the end of the seven (7) day period
– provision of goods made according to the consumer’s specifications, clearly personalized, or which, due to their nature, cannot be returned or are likely to deteriorate or expire quickly.
EARL CHAM B recommends that any Customer wishing to exercise their right of withdrawal inform Customer Service. A return number for the relevant product(s) will then be assigned. The Customer will receive an email, which must be included in the package, containing the return number and the address to which the product must be returned.
Packages for which no information is included to identify the sender (order number, first and last name, address) will not be accepted for return.
The product(s) must be returned in their original condition and packaging, complete, and accompanied by a copy of the purchase invoice and the completed return form or the email confirming the return number. The products must not have undergone any alteration of any kind.
After receiving and inspecting the products returned by the Customer, EARL CHAM B will send an email confirming the withdrawal and will proceed with the refund within a maximum of eight (8) days. Refunds are made via bank transfer for card payments and by check for payments made by check.
If the Customer’s withdrawal decision reaches EARL CHAM B before the relevant order has been prepared, EARL CHAM B will immediately cancel all or part of the affected order.
The costs and risks associated with returning the merchandise are the responsibility of the Customer sending it. The return of the product(s) will result in a refund equal to the purchase price of the returned product(s), including any amount paid by the Customer for delivery.
- Exchange, Refund
In the event of a non-conforming order, the Customer may return the product(s) received. In this case, for the return to be accepted, the Customer must notify Customer Service within five (5) days if they did not receive the correct item.
Any claim made after this period will not be accepted.
Returns will only be accepted for products in perfect condition, in their original state and packaging.
The product(s) must be returned, accompanied by the purchase invoice and the return authorization number, to our Customer Service.
Regarding the returned product, it will be refunded or exchanged according to your request and available stock. If a refund is to be issued, it will be processed within thirty (30) days of receiving your return. Return shipping costs may then be reimbursed upon presentation of proof.
- Warranty
EARL CHAM B is bound by the legal warranty against hidden defects, as defined in Articles 1641 et seq. of the French Civil Code, which states: “The seller is liable for hidden defects of the item that make it unfit for the use for which it is intended, or which so diminish that use that the buyer would not have purchased it, or would have paid a lower price, had they known of them.”
Consequently, the Customer has up to two (2) months from the delivery date to submit a claim to EARL CHAM B. Beyond this period, EARL CHAM B can no longer guarantee the products, as no quality control of the storage location can be performed, unless the Customer can provide proof that the product’s deterioration occurred prior to the sale.
EARL CHAM B will replace any products covered by the warranty that are deemed defective or refund part of the price to the Customer who chooses to keep the product.
EARL CHAM B does not guarantee the Customer against any potential harmful consequences that these hidden defects may have caused.

- Force Majeure
EARL CHAM B cannot be held liable for any loss or damage resulting from a delay or failure to perform any of its obligations under these Terms and Conditions if such failure is caused by a force majeure event, in accordance with Article 1218 of the French Civil Code.
- Jurisdiction
These Terms and Conditions are governed by French law.
Any dispute relating to the validity, interpretation, or execution of these Terms and Conditions must, as a first step and to the fullest extent possible, be resolved through amicable negotiations between the Parties.
If an amicable resolution cannot be reached, the dispute will be brought before the Judicial Court of Angoulême.
- Language
These Terms and Conditions are written in French.
In the event of a conflict between the French version and any version in another language, the French version shall prevail.
- Electronic Signature
The “Double Click” combined with the Client’s authentication and non-repudiation procedure during their order, and the acceptance of these General Terms and Conditions of Sale, constitutes an electronic signature within the meaning of Article 1316-4 of the French Civil Code, which provides:
“When it is electronic, it consists of using a reliable identification method that guarantees its connection with the act to which it is attached. The reliability of this method is presumed, unless proven otherwise, when the electronic signature is created, the identity of the signer is ensured, and the integrity of the act is guaranteed, under conditions set by a decree of the Council of State.”
- Liability
In the online sales process, EARL CHAM B is only bound by a best-effort obligation; its liability cannot be engaged for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruption, or other involuntary issues.
- Evidence
The computerized records, kept on the servers of EARL CHAM B as well as on the servers of its banking institutions, shall be considered as evidence of communications, orders, and payments made between the parties.
- Document Retention and Archiving
Transaction data is archived on a reliable and durable medium, in accordance with Article 1348 of the French Civil Code.
It is therefore carried out in compliance with the AFNOR Z 42-013 standard concerning the design and operation of computer systems to ensure the preservation and integrity of records stored in these systems.
- Personal Information
Similarly, every user has the right to verify the accuracy of this data and may request its correction or deletion by writing to EARL CHAM B at the following address: 152 rue du Pic Vert – 16130 JUILLAC-LE-COQ.
The information and contact details concerning the Client are confidential. They are used for processing orders and for sending information about products similar to those previously provided. The Client has the right to object, free of charge except for transmission costs, and in a simple manner, to the use of their contact information each time a message is sent. To do so, they simply need to write to the following address: 152 rue du Pic Vert – 16130 JUILLAC-LE-COQ.
- Intellectual Property
In accordance with the laws governing Intellectual Property (literary and artistic property rights, industrial property rights), this Website and all elements, trademarks, designs, logos, graphics, etc., found on this Website are the exclusive property of EARL CHAM B.
The reproduction or use of all or part of these elements is only permitted for information purposes for private personal use; any reproduction or use of copies made for other purposes is expressly prohibited. Any other use constitutes infringement and is punishable under Intellectual Property law, unless prior written authorization is obtained from EARL CHAM B.
